THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.1262 of 2025 ORDER:
This Criminal Petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of pre-arrest bail to the petitioner in connection with an unregistered crime of Yellareddypet Police Station, Rajanna Sircilla. 2.
Heard Sri J.Sai Krishna, learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that though the petitioner was assigned land in the year 2000, recently some complaints were raised by the Revenue Inspectors stating that petitioner and some others grabbed the Government land by way of forging the documents and number of FIRs were registered against the persons whose names are reflected in the news item. As such, petitioner is apprehending arrest in respect of land in Sy.No.119/1 to an extent of Ac.3.20 guntas of Venkatapuram
- 2 - Village, Yellareddypet Mandal, Rajanna Sircilla District. As such prayed this Court to grant pre-arrest bail to the petitioner. 4.
On the other hand, learned Additional Public Prosecutor would submit that as on today, no complaint is filed against this petitioner, no FIR was registered against him and on mere apprehension, bail cannot be granted and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, the petitioner herein filed Patta Certificate dated 06.08.2000 issued in favour of his wife. He also filed documents to show that from 2001 onwards petitioner herein is in possession of property and his possession is recorded in the pahanies, whereas, the allegations in the other FIRs are that due to the influence of political party the petitioner and other persons have grabbed the land by forging the documents, but the documents show otherwise. In view of the same, if any FIR is registered against this petitioner or in the event of his arrest, the petitioner is ordered to be released on pre-arrest bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees
- 3 - Twenty Five Thousand only) with two sureties, for the like sum each to the satisfaction of the Station House Officer, Yellareddypet Police Station, Rajanna Sircilla. The Station House Office shall accept the personal bond executed by the petitioner. Further, the petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case. 6.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
