THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42507 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the representation dt.26.11.2016 of the petitioner for giving protection at the time of survey & demarcation of land in Sy.No.115/2&3 situated in Khairatabad (V&M), Hyderabad is illegal, arbitrary, unjust and in violation of Art.21 & 300-A of the Constitution of India and consequently direct the respondents to consider the representation dt.26.11.2016 of the petitioner for providing protection at the time of conducting survey & demarcation of land in Sy.No.115/2&3 situated in Khairatabad (V&M), Hyderabad forthwith." 2.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that he made a representation to respondent No.4 on 26.11.2016 seeking police protection at the time of conducting survey and demarcation of the aforementioned land, but till date, no action is initiated and hence, prays to give a direction to respondent Nos.2 to 4 to consider the said representation.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, respondent Nos.2 to 4 are hereby directed to consider the representation, dated 26.11.2016, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
