Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents. 2.

The prayer sought in the writ petition is as under: '...to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in seizing of the 36.10 Quintals of Rice under the cover of Panchanama, Dt.14-05-2019 belonging to the Petitioner from his premises at H.No.2-1-43/1A, Saipur Village, Tandur Mandal, Vikarabad District as illegal, arbitrary, improper and without Jurisdiction and consequently direct the Respondents to forthwith release the Seized stocks of 36.10 Quintals of Rice to the Petitioner and pass such other order or orders may deem fit and proper in the circumstances of the case.'

At the time of hearing, it is brought to the notice of this Court that in a case with identical facts, this Court disposed of many writ petitions and one of such matters have been placed in the material papers at Page Nos.43 to 52 filed along with the writ petition. The petitioner submits that the seized rice belonging to the petitioner may be released subject to giving security in the form of bank guarantee/immovable property security.

Therefore, for the reasons alike as were stated, this Writ Petition is disposed of with a direction to the respondents to release the seized stock of 36.10 quintals of rice to the petitioner subject to his furnishing of 50% bank guarantee and remaining 50% immovable property security towards the value of the seized stock as determined by the second respondent. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
