ORDER
This writ petition is filed seeking the following relief: "...to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus to declare the action of the 2nd respondent in not passing any orders on the appeal petition filed by the petitioner on 7.1.2019 against the orders passed by the 3rd respondent dt. 03.01.2019 bearing No.E2/227(2)2018BSWD, as being illegal, arbitrary, unjust and against to the principles of natural justice, and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice."
Learned counsel appearing for the petitioner submits that the disciplinary authority has removed the petitioner from service vide order dated 3.1.2019, against which, he preferred an appeal before the 2nd respondent-appellate authority, but so far, no orders have been passed thereon.
Learned Standing Counsel appearing for the respondent-Corporation submits that the 2nd respondentappellate authority would consider the appeal filed by the petitioner and pass appropriate orders.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is given to the 2nd respondent to consider the appeal preferred by the petitioner.
Accordingly, the Writ Petition is disposed of directing the 2nd respondent to consider the appeal preferred by the petitioner and pass appropriate orders thereon within a period of six weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
