THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15681 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The petitioner was appointed as a fair price shop dealer in respect of shop No.27 of Isaka Damerla Village, Kondapur Mandal, S.P.S.R. Nellore District. While so, it appears that the Civil Supplies Deputy Tahsildar, Kaligiri inspected the shop of the petitioner at Iskadamerla village on 22-04-2015 and submitted a report on 01-05-2015 to the third respondent. Based on the said report, the third respondent issued a show-cause notice to the petitioner on 16-05-2015 framing four charges against the petitioner. Pending further enquiry, the authorization of the petitioner was suspended by proceedings of even date and the petitioner had already submitted her explanation on 25-05-2015. In view of the submission of the explanation of the petitioner, this Court is not inclined to keep the writ petition pending.

In the circumstances, the writ petition is disposed of directing the third respondent to conduct enquiry based on the allegations and explanation submitted by the petitioner by following law laid down by this Court and pass appropriate orders within a period of (30) days from the date of receipt of copy of the order.

Accordingly, the Writ Petition is allowed.

The miscellaneous petitions pending, if any, in this writ petition shall stand closed. There shall be no order as to costs.
