HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No. 5373 of 2017 ORDER:

The present Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, requesting to grant regular bail to accused No.4 in Crime No.14 of 2017 of Mothugudem Police Station, East Godavari District.

Heard Sri G.M.Swamulu, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Andhra Pradesh. Though, the learned counsel for the petitioner would submit that since 14.04.2017, the petitioner has been in judicial remand, it is a fact that a similar request made by the petitioner as well as accused Nos.2 and 3 was rejected by a common order, dated 19.06.2017, in Criminal Nos.3779, 3907 and 4017 of 2017 on the main ground that the quantity seized from the collective possession of the petitioners was commercial quantity and the other submission as to non-compliance of mandatory requirement of Section 50 of the Narcotic Drugs and Psychotropic Substances Act, which was not agreed, was rejected. Nothing else is required to reject the request made now.
