HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3632 of 2019 ORDER:

The petitioners seek to assail the appellate order dated 01.9.2018 passed by the Revenue Divisional Officer, Toopran Division, Medak District, in an appeal filed under Section 5-B of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. The petitioners are provided an efficacious alternative remedy by way of a Revision under Section 9 thereof. Without taking recourse to the said remedy, the petitioners chose to file this Writ Petition. Having heard Sri Mohd. Asifuddin, learned counsel for the petitioners, this Court finds no exceptional grounds in this case warranting the circumventing of the efficacious remedy provided to the petitioners under the statute.

If litigants are allowed to give a go-by to the hierarchy of remedies provided to them under the statute and approach this Court directly, the purpose of providing statutory remedies itself would be rendered futile. The Writ Petition is accordingly dismissed on this short ground leaving it open to the petitioners to take recourse to the remedy of Revision provided to them in accordance with the due procedure. It is made clear that this Court has not gone into the merits of the matter and it is open to the revisionary authority to adjudicate the matter on its own merits and in accordance with law in the event a Revision is filed.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
