Heard learned counsel for the petitioner as well as the learned standing counsel appearing for the respondent No.2 - Corporation. 2.

The prayer sought in the writ petition is as under: "... the Hon'ble Court may be pleased to issue writ order or direction more particularly in the nature of Writ of Mandamus declaring the proceedings dt.17.01.2020 issued by the 2nd respondents as illegal, arbitrary, violation of principles of natural justice and violative of the constitutional guarantee under Art.300A of the Constitution of India and consequentially direct the Respondents 2 to 4 receive the buildings plans as per the approved LRS and accord building permission for construction of building in Plot No.23, JNTU Nagar S.No.44/ 1, Miyapur, Serilingapally Mandal, Hyderabad in the interests of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

During the course of hearing, the learned standing counsel placed on record the written instructions dated 22.02.2020 issued by the Assistant City Planner, Chandanagar, Circle - 21, SLP Zone, GHMC.

From a perusal of the said written instructions, it is revealed that the petitioner submitted an application dated 17.01.2020 stating that Plot No.23 is in JNTU Welfare Association and not in Matrusri Co.op. Housing Building Society and requested to accord permission. After verification, the respondent No.2 - Corporation issued a shortfall letter dated 17.01.2020 informing the petitioner to upload copy of layout and tax receipt etc. The said shortfall letter is impugned in the present writ petition. Pursuant to the application dated 17.01.2020, submitted by the petitioner, the officials of the Town Planning Section

have once again visited and cross-checked the site and found that Plot No.23 of the petitioner also falls in Sy.No.44/ 1 of JNTU Colony, as such the GHMC will consider the issue the building permission for the Plot No.23 in Sy.No.44/ 1 of JNTU Colony, Miyapur, Serilingampally. 5.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. However, the respondent No.2 - Corporation is directed to complete the entire exercise for issuance of building permission for Plot No.23 in Sy.No.44/ 1, JNTU Colony, Miyapur, Serilingampally, within a period of four (4) weeks from the date of receipt of a copy of this order. As a sequel thereto, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ________________ P. KESHAVA RAO, J February 26, 2020 DSK
