Bandaru Lakshmi Narayana Rao v. The State Of Andhra Pradesh,

2015-09-09Sanjay Kumar1 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10520 of 2005 ORDER:

The grievance of the petitioner was with regard to the proceedings dated 21.04.2005 issued by the Collector and District Magistrate, Prakasam District, whereby his engagement as an In-charge Assistant Government Pleader for the Senior and Junior Civil Judge's Courts at Addanki, was terminated and he was asked to handover the charge.

No interim orders were granted by this Court and on the other hand, the miscellaneous petition filed seeking suspension of the impugned proceedings was dismissed.

Perusal of the impugned proceedings demonstrates that the petitioner had already completed two terms and was asked to continue as an In-charge Assistant Government Pleader till a fresh appointment was made. This is also borne out by the proceedings dated 21.04.2005 issued by the Collector and District Magistrate, Prakasam District.

In that view of the matter, the petitioner has no legal right to assert that he should be continued further on an In-charge basis. No such right vests in him after completion of two terms as a regular Assistant Government Pleader. The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
