HON'BLE SRI JUSTICE M. SEETHARAMA MURTI CMA.No.786 of 2004 JUDGMENT:
The learned counsel for the appellant submits that the matter has been settled out of Court and that an Award has been passed by the Lok Adalat Bench at Hyderabad.
Heard the learned counsel for the appellant and perused the Award.
Though the learned counsel for the appellant/National Insurance Company Limited did not appear before the Lok Adalat, the Deputy Manager of the said Company had appeared before the Lok Adalat and after the matter is amicably settled, the Adalat Bench presided over by a Chairman, who is a former Judge of this Court, had passed an Award. The identity and authority of the Deputy Manager, who had appeared before the Adalat, is not in dispute. In view of the above, the CMA is disposed of in terms of the Award of the Lok Adalat Bench at Hyderabad.
Miscellaneous petitions pending, if any, in this appeal shall stand closed.
