THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.21437 of 2007 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to issue a writ of mandamus declaring the notification issued under Section 4(1) of the Land Acquisition Act, dated 25.09.2007, in Rc.No.214/ 2007/ E2/ SW, issued by the 1st respondent which was published in Vaartha Telugu Daily Newspaper dated 29.09.2007 seeking to acquire the land in Sy.No.212/ 1B to an extent of Ac.0.58 cents situated at K.Kotapadu Village and Mandal, Visakhapatnam District, as illegal and arbitrary.

2. When the matter is taken up for hearing, it is submitted by the learned Government Pleader for Land Acquisition that the land acquisition proceedings initiated earlier, which is the subject matter in the writ petition, have been withdrawn and therefore, the cause of action in the writ petition do not survive. He placed the copy of the written instructions received by them, before this Court.

3. Recording the said submission of the learned Government Pleader, the writ petition is disposed of. Miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs. ___________________ T. AMARNATH GOUD, J February 08, 2018 KTL
