This application is filed by the petitioner to clarify the order dated 11.02.2025 passed in Crl.P.No.1307 of 2025 directing the lower court to enlarge the petitioner/A.10 on bail in Crime No.141 of 2023 of EOW CCS, TEAM-1, Hyderabad by modifying the impugned condition.
Learned counsel for the petitioner/A.10 submits that the present criminal petition is filed for grant of regular bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, whereas in the order dated 11.02.2025, in para No.1, it is mentioned as pre-arrest bail and that the conditions imposed in the criminal petition pertains to anticipatory bail. Hence, prayed to modify the order.
Having regard to the averments made in the affidavit filed in support of this application, and on considering the submissions made by learned counsel for petitioner, this Court is inclined to allow this application, correcting the typographical errors crept in, in order dated 11.02.2025 passed in Crl.P.No.1307 of 2025.
In view thereof, paragraph Nos.1 and 6 (i) (ii) and (iii) of the order dated 11.02.2025 passed in Crl.P.No.1307 of 2025 are modified and corrected, and
the same reads as under:
"This Criminal Petition is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') to enlarge the petitioner on bail, who is arrayed as accused No.10 in Crime No.141 of 2023 of EOW CCS, TEAM-1, Hyderabad.
6 (i). "The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Judicial Sessions Judge, Nampally, Hyderabad".
(ii) The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437 (3) of Cr.P.C.) Accordingly, the application is ordered.
Hence, the Registry is directed to carry out necessary amendments and issue amended copy.
