HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.25214 OF 2007 ORDER:

When the matter is taken up for hearing, counsel appearing for the parties have submitted that the issue raised in this writ petition is squarely covered by the order passed by this Court in W.P.No.4263 of 2007, dated 01.11.2018.

Counsel appearing for the petitioner has further submitted that the aforesaid orders were confirmed by a Division Bench of this Court in W.A.No.368 of 2019 dated 26.04.2019 and contended that this writ petition also be disposed of modifying the punishment from 'deferment of two annual increments with cumulative effect' to that of 'deferment of two annual increments without cumulative effect'. In view of the above submissions, this writ petition is disposed of modifying the punishment from 'deferment of two annual increments with cumulative effect', which was imposed by the reviewing authority i.e., the 2nd respondent vide order, dated 19.03.2002, to that of 'deferment of two annual increments without cumulative effect'. It is made clear that the above modified punishment is without any monetary benefits. No order as to costs.
