THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.2782 OF 2019 ORDER:
This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents in not considering and passing appropriate orders on the petitioner's representations dated 14.12.2018 and 29.12.2018, in terms of the proceedings dated 08.12.2014 of the 2nd respondent, as illegal and arbitrary and sought a consequential direction to the respondents to consider and pass appropriate orders on the representations of the petitioner.
Heard Sri M. Srinivasa Rao, learned counsel for the petitioner, and the learned Government Pleader for Services-II appearing for the respondents.
It has been contended by the petitioner that he was initially appointed as a constable with the police department on 15.08.1993 and he has worked as such upto 01.03.2000. Thereafter, the services of the petitioner were deployed with the registration department and finally his services were absorbed in the registration department. The petitioner further submits that he has submitted a representation to the respondents to count his earlier service rendered in the police department for the purpose of seniority, pay fixation and other benefits. Thereupon, vide proceedings dated 08.12.2014, the respondents were pleased to consider the request of the petitioner and extended all the benefits. However, the consequential proceedings were not released in favour of the petitioner and, therefore, the petitioner has submitted representations to the respondents on 14.12.2018 and 29.12.2018 requesting them to grant the consequential reliefs in pursuance of the proceedings dated 08.12.2014, but so far the respondents have neither passed any orders on the said
representations nor granted any consequential reliefs in pursuance of the proceedings issued by the 2nd respondent on 08.12.2014. Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner and pass appropriate orders in accordance with law.
Learned Government Pleader appearing for the respondents submits that since the representations submitted by the petitioner are pending, the respondents would consider the same and pass appropriate orders thereon in accordance with law.
This Court, having considering the rival submissions made by the learned counsel for the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations dated 14.12.2018 and 29.12.2018 of the petitioner and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With these observations, the writ petition is disposed of. No costs.
