THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14584 of 2015 ORDER:

This writ petition is filed for writ of Mandamus declaring the action of the respondents in initiating action for demolishing the petitioners' residential houses situated at Chandanagar Village, Ranga Reddy District, without issuing any notice, as arbitrary and illegal.

Petitioners state that they belong to weaker section and that they have constructed the subject houses about 20 to 25 years ago and have been paying the water charges, electricity charges and property tax regularly. It is their grievance that the respondent authorities are taking steps to demolish the subject houses, without following due procedure.

Heard both sides. Documents filed would disclose that the petitioners are in settled possession of the land which is admittedly classified as 'sarkari poramboke'. They cannot be evicted forcibly except in due process of law. Having regard to the fact that the petitioners are in possession of the subject houses since a long time, by paying water charges and electricity charges, the respondents are directed not to evict the petitioners from the subject houses, except in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ______________________ JUSTICE K.C.BHANU 14th May, 2015 IBL/VV
