HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A.M.P.No. 2640 of 2017 in W.A. No. 1410 of 2017 & W.A. No. 1410 of 2017 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This application is filed seeking to condone the delay of 104 days in filing the appeal.
In the affidavit filed in support of the application, it is stated that the writ petition was disposed of on 17.04.2017 and Copy Application was filed on 21.08.2017 and the order was made available on 29.08.2017.
The learned counsel for the respondent submits that the Registry of this Court dispatched the certified copy of the order dated 17.04.2017 on 19.05.2017. In spite of that the appeal is filed with an inordinate delay of 104 days and laches which are not properly explained by the petitioner. In view of the above, we are not inclined to condone the delay.
Hence, the Miscellaneous Application is dismissed. Consequently, the writ appeal is rejected. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
