HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.37232 of 2015 ORDER:

The petitioners state that they are cultivators of agricultural lands in Sy.Nos.308 to 320 of Sangam Village and Mandal, SPSR Nellore District, and they are small farmers. The petitioners state that they made a complaint to the 4th respondent with regard to unauthorized encroachments over large extent of Government land and land allotted to the members of the Weaker Sections of the Society and also made a complaint with regard to grabbing of the land covered by the Irrigation channel, which resulted in depriving the petitioners passage as well as irrigation water to their lands. On the said complaint, an enquiry seems to have been conducted by the 4th respondent and under Endorsement Rc.No.526/15, dated 16-09-2015, he confirmed the encroachment and assured of taking appropriate action and submitted a report to respondents 2 and 3.

The petitioners state that in spite of the said report pending with respondents 2 and 3, no further action is taken by them and seek a direction as prayer for, for the inaction of respondents 2 and 3. Heard the learned Government Pleader for Revenue. Keeping in view the fact that report of the 4th respondent is already before respondents 2 and 3 for necessary directions, it is appropriate to direct respondents 2 and 3 to issue appropriate directions to the 4th respondent for early resolution of the issue, as expeditiously as possible. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.
