THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37033 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in calling the petitioner to the police station, making him to sit in the police station and threatening to disburse the amounts credited to the PEARLS as illegal and violation of Articles 14 and 21 of the Constitution of India, and consequently to direct the second respondent not to interfere with the petitioner's personal life and liberty in any manner. Heard and perused the material.

Learned counsel for the petitioner submits that without therebeing any case registered against the petitioner, the second respondent is frequently calling the petitioner to the police station and making him to sit in the police station hours together. He further submits that the petitioner is only a collection agent in Pearls Agrotech Corporation Limited and that he has not committed any offence and no case is registered against the petitioner. Hence, he prays this Court to direct the second respondent not to interfere with the personal affairs of the petitioner.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the second respondent is not interfering with the affairs of the petitioner and they are not threatening the petitioner in any manner.

Considering the rival submissions made by both the counsel, the second respondent is directed not to call the petitioner to the police station and not to interfere with the affairs of the petitioner in any manner, without therebeing any crime registered against the petitioner.

The second respondent is further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
