HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.No.24907 of 2017 ORDER:

This writ petition is filed alleging that the respondents are taking steps to remove the tin roof petty shops of the petitioners situated in the land of Singareni Collieries Company Limited situated at Ambedkar Nagar, Bhupalpally without following due process of law.

Heard learned counsel for the petitioners, who says that the petitioners have obtained trade licence from the 2nd respondent municipality. But the 2nd respondent, without issuing notice, is trying to dispossess the petitioners. Sri N.Praveen Kumar, learned Standing Counsel for the 2nd respondent says that the petitioners have erected petty shops by encroaching road margin. As such, necessary action is being taken. The same is disputed by learned counsel for the petitioners.

Heard Sri J.Srinivas, learned Standing Counsel for the 3rd respondent.

In view of the facts and circumstances of the case, once the respondents want to clear the encroachments, it is open for them to follow due process of law.

Accordingly, the writ petition is disposed of. The petitioners shall not be dispossessed without following due process of law.
