From the reading of the averments in the affidavit filed in support of the Writ Petition, it appears there is dispute between petitioner and the persons, by name, Feroz Khan and Afroz Khan. Alleging that those two persons along with their henchmen and some unknown ladies attacked the petitioners and her family members with sticks, complaint was filed. It is alleged that those persons were aiming to kill the petitioner and her family members and trying to grab their property. Petitioner alleges that she immediately called the Deputy Commissioner of Police and informed the said incident. According to the petitioner, though Police visited the scene of offence, apprehended all the accused, there is no further progress. As per the averments in paragraph-6 of the affidavit, based on the complaint filed by the petitioner, Crime No.

690 of 2017 was registered in Banjara Hills Police Station. Petitioner alleges that there is no progress in the investigation. It appears, petitioner also filed private complaint in the Court of III Additional Chief Metropolitan Magistrate, Hyderabad, and the Magistrate in turn referred the complaint to the Banjara Hills Police Station. However, affidavit is silent as to what steps are taken later. Petitioner sought to contend that appropriate penal provisions are not incorporated in the crime registered.

As per the instructions furnished to the learned Government Pleader, after completing the investigation, charge sheet is filed before the Court of III Additional Chief Metropolitan Magistrate at

Hyderabad and Police are awaiting orders of the Court taking cognizance of offence. As there are no other clear averments with reference to the grievance, which petitioner sought to ventilate vaguely, Writ Petition is dismissed, leaving it open to petitioner to file appropriate petition before the concerned Police if she is not satisfied with the manner of conducting investigation and not incorporating the relevant provisions of law in the crime.
