THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23170 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondent Nos.3 and 4 in trying to interfere with the civil and business disputes and between the petitioner and R-5 and also insisting the petitioner to settle the disputes, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to respondent Nos.4 to 8.

The case of the petitioner, as seen from the affidavit filed in support of the Writ Petition, is that about three years back, the petitioner asked the fifth respondent to send some material, since both were dealing with organic products. However, as the stock sent by R-5 was not upto the specifications, the petitioner returned the said stock and in that regard some disputes arose between the petitioner and R.5. With regard to settlement of said transaction, respondents 6 to 8 approached the petitioner and insisted him to settle the issue, at the behest of R-4, who happens to be the friend of R.6. Thus, alleging interference by the Police in civil disputes, the present writ petition came to be filed.

Learned AGP, on instructions, denied the allegations made in the affidavit filed in support of the writ petition. He further

submits that the respondents-Police never interfered with the civil disputes, which are said to be pending between the parties. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police not to interfere with the civil disputes, which are said to be pending between the parties. However, if they intend to take any action against the petitioner, they shall follow the procedure established under law. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
