HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.10343 and 10349 OF 2017 ORDER:

The orders, of the A.P. Endowments Tribunal, Pedakakai, Amaravathi, in O.A.Nos.329 and 331 of 2015 dated 20.12.2016, are challenged before this Court. It the specific contention of the learned counsel for the petitioners that, orders have since been passed ex parte, the merits of the petitioners' cases could not be considered. He would further contend that, though the petitioners engaged advocate, he does not appear to have filed counter affidavit nor had appeared before the Endowments Tribunal.

Learned Standing Counsel for Endowments, while opposing the Writ Petition, would submit that, Rule 11(3) of the A.P. Charitable and Hindu Religious Institutions and Endowments Tribunals Rules 2009 (the Rules), provide for an opportunity to the petitioner to seek setting aside the order made ex parte. He would further assert that, if such application is made, the same shall be considered by the Tribunal.

Considering the respective submissions and, particularly, the submission made on behalf of respondent No.3 - Temple, Writ Petitions are disposed of giving liberty to the petitioners to file applications, under Rule 11(3) of

the Rules, before the Endowments Tribunal, which shall be considered in accordance with law.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
