HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3923 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.18, 19 and 20 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.113 of 2015 of II Town Police Station, Nandyal, Kurnool District registered for the offences punishable under Section 420 r/w 149 IPC, Section 5 of the Andhra Pradesh Protection of Depositors of Financial Establishment Act, 1999.

2) Heard learned counsel for the petitioners/ accused Nos.18, 19 and 20 as well as the 1st respondent representing through public prosecutor before admission and before ordering any notice to the 2nd respondent-de facto complainant. Perused the material on record.

3) A perusal of the material no way suffice to admit the application filed under Section 482 Cr.P.C to quash the FIR as there is accusation. No doubt, as submitted by the learned counsel for the petitioners for the original collection of depositors, these petitioners are not parties but for subsequently in settlement in postponing and recovery, though it is the contention that the material falls short to say there is privy with main accused No.1 or with others.

4) Having regard to the facts of the case, the Criminal Petition is disposed of, by giving liberty to petitioners to surrender before the Learned Special Judge concerned and move for regular bail with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Special Judge shall consider for granting of bail in their favour with necessary conditions preferably on the same day.

5) Miscellaneous petitions, if any pending, shall stand closed.
