HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 20601 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to and connected with I.D.No.122 of 1999 on the file of the 3rd respondent-Labour Court and quash the order dated 23.04.2002 passed therein directing the respondents to issue fresh appointment to the petitioner on daily wage basis as and when vacancies arise, holding it as illegal and arbitrary. A consequential relief is also sought to direct the respondents 1 and 2 to reinstate the petitioner into service with continuity of service, back wages and attendant benefits.

When the matter is taken up for hearing today, it is noticed that the petitioner has retired from service on attaining the age of superannuation. Therefore, the relief sought by the petitioner cannot be granted at this point of time. Further, the writ petition was dismissed for default against respondent No.1 vide orders dated 18.08.2010 and, thereafter, no steps have been taken to restore the writ petition against the respondent No.1.

In view of the above, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 8th November, 2018 cbs
