THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Second Appeal No.809 of 1987 JUDGMENT:

On 14.08.2015, this Court had passed the following order: This appeal is remanded by the Supreme Court for fresh hearing.

I have perused the detailed report placed by the Registrar (Judicial) on record.

The learned counsel for the respondents 1 to 3 would submit that the former counsel for the appellants had died and that, therefore, notices are taken to the appellants and that though the appellants, who are alive are served with notices, they did not appear before this court on any hearing date and also today and that since the appellants, who are surviving are not showing any interest, the appeal may be dismissed for default.

Having regard to the note of the Registrar (Judicial) and the submissions of the learned counsel for the respondents, list the appeal on 21.08.2015 under the caption 'For Dismissal'.

2. Despite listing the matter under the caption 'For Dismissal', there is no representation for the appellants. However, the learned counsel for the respondents is present.

3. Therefore, the Second Appeal is dismissed for default. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this appeal shall stand closed.
