HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33205 of 2011 ORDER:

With the consent of both the parties, the main writ petition is disposed of at the admission stage.

The present writ petition is filed seeking issuance of a writ of mandamus declaring the action of the respondents in not issuing pattadar pass books and title deeds to the petitioner in respect of land admeasuring Ac.2.80 cents in Sy.No.323/B2A situated at B.Thandrapadu Village, Kurnool Mandal and District, as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to issue pattadar pass book and title in favour of the petitioner in respect of the above said land. The averments in the affidavit filed in support of the writ petition would show that the petitioner is the owner of land admeasuring Ac.2.80 cents in Sy.No.323/B2A situated at B.Thandrapadu Village, Kurnool Mandal and District.

It is stated that originally, the Tahsildar, Kurnool issued ryotwari pass book in favour of the petitioner, but he lost the same during the floods in Kurnool. Thereafter, the petitioner made an application dated 29.04.2011 before the second respondent enclosing a Xerox copy of the ryotwari pass book issued by Tahsildar, Kurnool seeking issuance of a new pattadar pass books and title deeds. It is stated that though the representation was made in the year 2001, till date it is pending.

Having regard to the circumstances stated above and without going into the merits of the case, the second respondent is directed to consider the representation dated 29.04.2011, if any made by the petitioner and pass orders in accordance with law within a period of six

(06) weeks from the date of receipt a copy of this order. With the above direction, the Writ Petition is disposed of. No order as to costs.
