Heard learned counsel for petitioner and the learned Public Prosecutor, for respondent.

The grievance of the petitioner is that he filed Crl.M.P. No.----- of 2014 under Section 70(2) Cr.P.C in C.C.No.308 of 2013 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad, for recall of N.B.W issued against him on 07.11.2014 and so far, the petition is not disposed of and the threat of arrest due to N.B.W is hanging on his head and therefore, N.B.W may be recalled.

Considering the submission that the petitioner/accused on earlier occasions either appeared personally or got filed absent condonation petitions and it was only on 07.11.2014 due to his absence NBW was issued, N.B.W is recalled.

In the result, the Criminal Petition is allowed and N.B.W issued against the petitioner/accused by the learned XIV Additional Chief Metropolitan Magistrate at Hyderabad, is hereby recalled.

The petitioner/accused is directed to promptly attend the Court hereafter. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
