HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 20267 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 1st respondent in issuing G.O.Rt.No.53, Higher Education (CE.II-I) Department, dated 18.01.2008 rejecting the relaxation of minimum marks of 55% in PG degree in favour of the petitioner to be appointed as Lecturer in Physics in 3rd respondent college, as illegal and arbitrary.

Learned counsel for the petitioner submits that during pendency of the writ petition, the petitioner has retired from service on attaining the age of superannuation. He contends that the service rendered by him from the date of his initial appointment till the date of retirement may at least be considered for the purpose of pensionary benefits and to that effect necessary orders may be passed. Having considered the said submission, this Court is of the view that ends of justice would be met, if the writ petition is disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon, in addition to the earlier representations submitted by the petitioner on 02.01.2000 and 02.06.2003, within four weeks thereafter, in accordance with law.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. _____________________________ ABHINAND KUMAR SHAVILI, J 23rd November, 2018 cbs
