Heard learned counsel for the petitioners/ A1 to A6 of Crime No.503 of 2016 on the file of the Machavaram Police Station, Vijayawada, registered for the offences punishable under Sections 506, 323, 449 r/ w 149 I.P.C. and learned Public Prosecutor representing the State before ordering notice to respondent No.2. Perused the grounds urged in the quash petition and other material on record.
It is the contention of the learned counsel for the petitioners that from perusal of the F.I.R. besides the same is a false outcome, no offence under Section 449 I.P.C. attracts. In fact, there is a force in the contention of the learned counsel for the petitioner and it is not sufficient to interdict the investigation.
Having regard to the above, the Criminal Petition is disposed of, directing the police not to arrest the petitioners pending investigation and they can secure any of the accused for the purpose of investigation, as and when required.
