ORDER
1. This writ petition, under Article 226 of the Constitution of India, is filed seeking a direction to the respondents 3 to 5 to register the complaint dated 28.04.2015 of the petitioners made against the respondents 6 to 9.
2. Heard learned counsel for the petitioners and learned Government Pleader for Home.
3. When the matter is called, learned Government Pleader for Home submitted the written instructions dated 09.07.2015 of the Sub Inspector of Police, Tiruchanur Police Station, Tirupati Urban District, which reads as under: " The facts of the case are that the 1st petitioner herein and one G.Ranjith Kumar lodged a complaint on 28.04.2015 with the Inspector of Police, Tiruchanur, Tirupathi Urban District, stating that he one of the owner of the land in S.No.377/1, 377/3 of Avilalal Village Account, Tirupathi Rural Mandal, But the respondents 6 to 9 and others trespassed into the said land, demolished the house, trees situated in the said land, beat the workers who was working in the said land and threatened with dire consequences. The complainant requested the police to take necessary action.
It is submitted that basing on the said complaint a case in Cr.No.97/2015 dated 28.04.2015 under Sections 447, 427, 324, 506 read with 149 IPC has been registered against the respondents 6 to 9 and others on the file of Tiruchanur Police Station, Tirupati Urban District and investigation has been taken up. The matter is under investigation. After completion of investigation and appropriate report will be submitted before the Hon'ble Court at the earliest.
The contention of the petitioner that the respondents 3 to 5 police did not register the complaint of the petitioners is false, hence denied. It is submitted that the writ petition has been filed on 24.06.2015 and the FIR NO.97/2015 was registered on 28.04.2015 under Sections 447, 427, 324, 506 read with 149 IPC against the respondents 6 to 9 and others on the file of Tiruchanur Police Station, Tirupati Urban District."
4. On noticing the said instructions, it is requested by learned counsel for the petitioners to record the said instructions and to dispose of the writ petition.
5. In view of the above, the writ petition is disposed of recording the written instructions dated 09.07.2015 furnished by the Sub Inspector of Police, Tiruchanur Police Station, Tirupati Urban District.
