THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8246 of 2010 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking a writ of certiorari calling for the records relating to the orders of the first respondent passed in C.T.A.No.21 of 2009 dated 26.11.2009 confirming the orders passed by the second respondent in Rc.No.1063/2003-C dated 20.11.2006 and consequently, set aside the same.
Today, when the matter is taken up for hearing, learned counsel for the petitioner submitted that as per the orders of surcharge proceedings as confirmed by the first respondent in C.T.A.No.21 of 2009, the petitioner has already paid the entire amount and hence, the prayer in the writ petition does not survive.
Recording the submission of the learned counsel for the petitioner, the writ petition is closed as no orders are necessary. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 06.02.2017 Tsr
