HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 24394 of 2011 ORDER:

The present Writ Petition is filed to declare the proceedings No. G/1576/2011 dated 11.07.2011 passed by the second respondent wherein the proceedings No.1079/2004 dated 30.04.2004 passed by the third respondent were stayed pending disposal of appeal, as arbitrary and illegal. At the time when the matter is taken up for hearing, the counsel for the petitioners placed on record the order dated 15.03.2014 passed in Proceedings No.G/1576/2011, wherein and whereunder the Revenue Divisional Officer, Medak Division (second respondent), disposed of the appeal filed by the fourth respondent herein on the ground that the matter is subjudiced in the Higher Court.

As seen from the order, the third respondent herein is said to have passed mutation proceedings in favour of the petitioners without providing an opportunity to the fourth respondent herein. Aggrieved by the said mutation proceedings, the fourth respondent herein preferred the appeal. Initially, by an order dated 11.07.2011 vide Proc.No.G/1576/2011, the second respondent granted interim suspension of the orders passed by the third respondent in Proc.No.1079/2004 dated 30.04.2004, till the disposal of main appeal.

Subsequently, the Revenue Divisional Officer is said to have disposed of the appeal itself. In view of the final orders passed by the Revenue Divisional Officer (second respondent) in disposing of the appeal itself, no further orders need be passed in this writ petition.

Hence, the Writ Petition is dismissed, leaving it open to the petitioners and also the fourth respondent to avail the remedies available under law. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
