THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.23428 of 2016 ORDER : (per Hon'ble Sri Justice Sanjay Kumar) Aggrieved by the order dated 13.07.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1878 of 2012, the State and its Officers are before this Court by way of this writ petition. Perusal of the order under challenge reflects that the Tribunal directed the petitioners herein to pay interest @ 9% per annum on the delayed payments made to the first respondent/applicant towards his pensionary benefits from the date of retirement till the actual payment. It is not in dispute that the first respondent/applicant retired on 28.02.2011.
It is also not in dispute that he was permitted to retire without prejudice to the outcome of the pending investigations into the allegations levelled against him. However, it is fairly conceded by the learned Government Pleader for the State of Telangana that nothing emerged out of such investigations and no action was initiated against the first respondent/applicant.
The material placed before us demonstrates that the first respondent/applicant submitted his pension documents and required papers as early as on 10.03.2011, i.e. immediately after his retirement and despite the same, he was not paid his retirement benefits till the year 2012.
In that view of the matter, we find no irregularity in the order under challenge, whereby the Tribunal directed payment of interest upon such payments which were delayed without just cause.
The writ petition is devoid of merit and is accordingly dismissed. The petitioners are given one month time from the date of receipt of a copy of this order to comply with the order passed by the Tribunal. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
