THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3523 OF 2010 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus to declare the order of respondent No.2 issued in Rc.No.1091/2009.S1, dated 15.10.2009, as illegal and arbitrary, and consequently, to direct respondent No.2 to approve the list of works approved by the Mandal Praja Parishad on 22.09.2009.

2. Vide impugned order, administrative sanction was accorded by respondent No.2 to take up the road works and the Executive Engineer, Panchayat Raj, Parvathipuram was authorized to execute the works and complete the same on or before 31.03.2010.

3. At the time of admission of the writ petition on 23.02.2010, no interim order was granted by this Court. The impugned order pertains to the year 2009 and the same stipulates that the works mentioned therein have to be completed by 31.03.2010. Since no interim order was granted, by afflux of time, the cause in this writ petition does not survive for adjudication and hence, no further orders are required to be passed in this Writ Petition.

4. Accordingly, the Writ Petition is dismissed as infructuous. However, liberty is granted to the petitioner to agitate her rights as and when fresh proceedings are issued affecting her rights. There shall be no order as to costs.
