THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT W.P.NOS.27186, 27192, 27214 AND 27257 OF 2016 COMMON ORDER Heard the counsel for the petitioners and the Government Pleaders for Land Acquisition, Roads and Buildings and Social Welfare.

Vide notifications dated 10.2.1992, 12.3.1992 and 10.11.1977 issued under Section 4(1) of the Land Acquisition Act, 1894 (for short 'the Act'), lands of the petitioners, along with lands of other owners, were acquired by the Government for the purposes of providing house sites to weaker sections and for laying railway line from B.B. Nagar to Nadikudi respectively. The Land Acquisition Officer awarded compensations. Some of the land owners, whose lands were also acquired under the very same notifications, sought a reference to civil court under Section 18 of the Act. The civil court in those cases, enhanced the compensation.

Based on the said judgments of civil court, the petitioners in these writ petitions, made applications under Section 28-A of the Act for re-determination of compensation and for payment of enhanced compensation on par with other claimants. As no enquiry was conducted under Section 28-A of the Act, all the petitioners got issued legal notices dated 11.7.2016. Aggrieved by the inaction of the respondents in considering the applications filed under Section 28-A of the Act, the present writ petitions have been filed.

The learned counsel for the petitioners submitted that the

respondents may be directed to dispose of legal notices dated 11.7.2016.

In view the above averments and the submissions of the learned counsel, the writ petitions are disposed of directing the respondents concerned, to take decision on the legal notices dated 11.7.2016, said to have been issued by the petitioners, within a period of four weeks from the date of receipt of a copy of this order. The decision taken shall be communicated to the petitioners, in writing, within one week thereafter. No costs. Miscellaneous petitions pending if any, shall stand closed.
