ORDER

When the matter is taken up for hearing, it is noticed that the writ petition filed against the 2nd respondent was dismissed on 28.04.2009 and no steps have been taken by the learned counsel appearing for the petitioner to restore the writ petition against the 2nd respondent.

Since this writ petition is filed questioning the appointment of the 2nd respondent as Executive Officer, without hearing the 2nd respondent the Writ Petition cannot be adjudicated. In view of the above, the cause in this writ petition does not survive for adjudication and accordingly, the Writ Petition is dismissed as infructuous. No costs.
