THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO I.A.No.3 of 2018 in/and Criminal Revision Petition No.804 of 2018 ORDER :
P.W.1-Mohd.Ghouse Pasha the complainant and his daughter Raheemunnisa the victim, a major are impleaded as respondents 2 and 3 by the Court.
Registry to carry amendment in the cause title of revision from the cause title of I.A.No.3 of 2018.
The petitioner is A.3 in C.C.No.237 of 2015 on the file of the XIV Addl.Chief Metroplitan Magistrate Court, Hyderabad, outcome of Cr.No.891 of 2014 of Panjagutta Police Station registered for the offences punishable u/sec.406 and 420 IPC. The trial Court convicted the petitioner/A.3 in C.C.No.237 of 2015 by its judgment dt.08.02.2017 and the same is confirmed by the appellate Court by its Judgment dt. 16.03.2018 in Crl.A.No.136 of 2017. Aggrieved by the same, the A.3 preferred the present revision.
Both the defacto-complainant and his major daughter the victim girl and the revision petitioner/A.3 along with their counsel present and seeking to compound the offences from the fact that the A.1 already compromised with the defacto-complainant and the victim as per the proceedings before the Lok Adalath dt.23.12.2018 in the split up case C.C.No.166 of 2017 of self same crime supra.
In view of the above submission, the same is recorded and they are permitted to compound the offences.
In the result, the I.A.No.3 of 2018 is allowed. Consequently, the Criminal Revision Case is also allowed setting aside the conviction sentence passed by the trial Court against the petitioner/A.3 in
C.C.No.237 of 2015 on the file of the XIV Addl.Chief Metropolitan Magistrate Court, Hyderabad, confirmed by the appellate Court in Crl.A.No.136 of 2017. The petitioner/A.3 is acquitted and his bail bonds shall stand cancelled. Pending miscellaneous petitions, if any, shall stand closed.
