THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 7788 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "That this Hon'ble Court may be pleased to issue a writ or direction more particularly one in the nature of writ of mandamus, declaring the inaction of the respondents No.2 to 5 not registering complaint filed against the unofficial respondents No.6 to 11 by the petitioner representation dated 02-03-2015, 02-02-2016, 14-02-2016 is illegal, arbitrary and violation of principles of natural justice and consequently, direct the Respondents No.2 to 5 to register the complaint against unofficial Respondents No.6 to 11, forth with, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. The Assistant Sub-Inspector of Police, Pedda Mandyam Police Station, Chittoor District, furnished written instructions dated 21.03.2016 to the office of the learned Government Pleader for Home, wherein he stated that no complaints had been received on the dates mentioned by the petitioner.

3. In the light of the afore-stated facts, Sri K.Srinivas, learned counsel for the petitioner, fairly stated that his client would make a fresh complaint.

4. In that view of the matter, the Writ Petition is disposed of permitting the petitioner to make a fresh complaint, if warranted, in accordance with law. The respondent police authorities shall take appropriate action on the said complaint, if made, in the light of the law laid down by the Supreme Court in Lalita Kumari vs. Government of Uttar Pradesh[1],
