THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI I.A.No.3 of 2018 In/And APPEAL SUIT No.570 of 2009 COMMON JUDGMENT:

When this Appeal Suit is taken up for hearing, the appellant and the 2nd respondent are present before this Court. The appellant is identified by Sri K.Pruthvi Raj, learned counsel, who stated that he is the colleague of Sri B.Adi Narayana Rao, learned Senior Counsel appearing for the appellant; and, the 2nd respondent is identified by Smt. A.Chaya Devi, learned counsel appearing for the 2nd respondent. The parties present produced their Identity Cards, namely Aadhar Card and Pan Card respectively and copies of the same are placed on record. 2.

The appellant and the 2nd respondent admitted the terms of compromise. As per the terms of compromise, the 2nd respondent agreed to pay Rs.2,45,000/- to the appellant towards her share in the schedule mentioned property as per her demand; and, the said sum is paid by way of a Demand Draft bearing No.867609, dated 19.11.2018, drawn on Oriental Bank of Commerce, Kukatpally Branch, Hyderabad; and the same is received by the appellant from the 2nd respondent in open Court. In view of the said payment towards full & final settlement and acceptance of the same with free will & consent, the appellant gave up all her claims and rights whatsoever in respect of the subject property against all the respondents in the Appeal Suit and stated that she is, therefore, withdrawing the Appeal Suit against the respondents. 3.

In view of the admission of the terms of compromise before the Court when read over and explained to the parties and as this Court is satisfied that the parties entered into compromise with free will &

MSRM, J A.S.No.570 of 2009 consent and without any force from any quarter, IA.No.3 of 2018 is ordered.

In the result, the Appeal Suit is disposed of in terms of compromise insofar as the appellant and the 2nd respondent are concerned and the Appeal Suit, as desired by the appellant, is dismissed against the respondents 4 & 5. The memorandum of compromise shall form part of the decree.

There shall be no order as to costs.
