THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2791 of 2019 ORDER:
Aggrieved by the inaction of the 2nd respondent - Greater Hyderabad Municipal Corporation, represented by its Commissioner, in granting building permission to the petitioners, and in returning their building permission application vide File No.1/C21/02025/2019 on the ground that land grabbing case in L.G.C.No.29 of 2006 was filed by the Revenue Divisional Officer, Chevella, the present writ petition has been filed.

Heard the learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 and Sri Sampath Prabhakar Reddy, learned Standing Counsel for Municipal Corporation - respondents 2 and 3.

All the learned counsel submits that this Court in identical set of facts and circumstances in W.P.No.22280 of dated 02.07.2018 disposed of the writ petition with the following direction:
"Following the above orders, this Writ Petition is disposed of, directing respondent Nos.2 and 3 to consider the application of the petitioner for grant of building permission in the subject land within a period of eight (08) weeks from the date of receipt of a copy of this order, subject to the petitioner satisfying the requirement of Section 428 of GHMC Act and also giving an undertaking that he would not claim equities or costs of the building construction, in the event LGC has been decided against him, without reference to the letter dated 31-10-2013 of the Zonal Commissioner, GHMC, Hyderbad."

Learned counsel for the petitioners submits that the present writ petition may also be disposed of accordingly. 5.
Having regard to the facts and circumstances of the case and the submissions of the respective counsel, this writ petition is disposed of in terms of the above directions of this Court in W.P.No.22280 of 2018 dated 02.07.2018. No order as to costs. 6.
Miscellaneous applications, if any pending in this writ petition, shall stand closed.
