HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.920 of 2005 ORDER:

On the representation made by the learned counsel for the petitioner on 05.06.2018 that the 1st respondent/defacto complainant died, six weeks time was granted to bring the legal representatives of the deceased 1st respondent on record. However, since the revision pertains to the year 2005, the matter was posted to 19.06.2018. On 25.06.2018, when the matter listed, it was adjourned to 09.07.2018 at the request of the petitioner. Today, when the matter is listed, the learned counsel appearing for the petitioner informed this Court that the petitioner is unable to get the information relating to the legal representatives of the deceased 1st respondent/complainant. Further, the 1st respondent also divorced his wife and he is not able to get any information, thereby, the learned counsel expressed his inability to take steps to bring the legal representatives of the deceased 1st respondent on record. According to him, the 1st respondent died more than six months ago.

In this view of the matter, by this time the proceedings are abated, since the petitioner failed to take steps by filing a petition to bring the legal representatives of the deceased 1st respondent on record.

In these circumstances, the criminal revision case is dismissed. However, the counsel for the petitioner is given liberty to move an appropriate application as and when the particulars of the legal representatives of the deceased 1st respondent are furnished to him.
