HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1812 OF 2017 ORDR:

The sole accused in C.C. No.62 of 2014 on the file of Additional Judicial Magistrate of First Class, Kandukuru, Prakasam District filed the present petition under Section 482 of the Code of Criminal Procedure (for short, 'the Code') to quash the proceedings in the aforesaid Calendar Case.

The petitioner, who is the husband of respondent/de facto complainant, alleged to have committed the offences punishable under Sections 498-A of IPC and under Sections 3 and 4 of Dowry Prohibition Act.

The learned counsel initially, though sought for quashment, however, restricts the relief to the extent of directing the learned Magistrate to dispose of the matter by fixing timeline. 4.

The fact that the petitioner is facing disciplinary proceedings is borne out from the proceedings dated 24.8.2016 issued from the office of the District Fire Officer, Prakasam District, Ongole and the fact that the Calendar Case relates to the year 2014, certainly, makes this Court to give such a direction, as requested by the learned counsel for the petitioner.

Therefore, the learned Additional Judicial Magistrate of First Class, Kandukuru, Prakasam District is directed to dispose of C.C. No.62 of 2014 on his file within six months from the date of receipt of a copy of this order.

The Criminal Petition is, accordingly, disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
