HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 936 of 2022 O R D E R:
This Criminal Petition under Section 440(2) read with Section 482 Cr.P.C. is filed to relax the condition imposed by the learned XII Additional Chief Metropolitan Magistrate, Hyderabad vide order dated 04.10.2021 in Crl.M.P.No. 2269 of 2021 in Crime No. 5 of 2021 on the file of Cyber Crimes Police Station, CCS, DD, Hyderabad.

The learned Magistrate by the aforesaid order granted bail to the petitioners. While granting bail, the petitioners were directed to execute a personal bond for a sum of Rs. 25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each; they shall appear before the SHO concerned on every Monday, Wednesday and Saturday for a period of two months or till filing of charge-sheet whichever is earlier; they shall not leave the country till disposal of the main case; the petitioners shall cooperate with the investigating agency as and when required and they shall file copy of their Aadhar card and their residence gas connection proof. 3.
Learned counsel for the petitioners Sri M. Phani Kumar submits that petitioner is aggrieved as far as the condition of executing personal bond for a sum of Rs.25,000/-. He submits that though bail was granted on 04.10.2021, till now, the petitioners are not able to fulfill the said condition as there are four cases registered against them.

On the other hand, learned Assistant Public Prosecutor submits that the petitioners belong to Jharkhand State and the Court below taking into consideration all the allegations in the complaint, had imposed such a condition which is just and proper, hence, the same need not be relaxed. 5.
Taking into consideration the fact that though bail was granted on 04.10.2021, as the petitioners could not execute bail bonds, they have been languishing in jail, this Court deems it appropriate to modify the said condition imposed by the learned Magistrate. The petitioners - Accused Nos. 1 to 4 shall execute a personal bond for Rs.15,000/- (Rupees fifteen thousand only) each with two sureties for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate, Hyderabad. The other conditions will remain intact.
