HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.16070 of 2017 Order:

This Writ Petition is filed challenging the order passed by the second respondent dated 09.04.2017 cancelling the community certificate issued in favour of the petitioner.

In the said order it is clearly stated that there is a provision for appeal within thirty days from the date of receipt of copy of the order, but the petitioner, without availing the remedy of appeal, filed the present Writ Petition.

Learned counsel for the petitioner submits that an appeal has already been pending against the similar order passed against the petitioner's mother and the said appeal is not yet disposed of. If that is so, this Writ Petition is disposed of giving liberty to the petitioner to prefer an appeal before the first respondent within fifteen

(15) days from the date of receipt of a copy of this order and, on receipt of the same, the first respondent shall take up the appeal of the petitioner as well as that of her mother, preferred against the order dated 29.12.2013 in Appeal No.RC.C5(M)/1576/13, and dispose of the same by giving due opportunity to the petitioner and her mother and after verifying the record within a period of six (6) months thereafter. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
