THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.460 of 2016 ORDER:

This application is filed to withdraw H.M.O.P.No.8 of 2016 from the Court of Senior Civil Judge, Kovuru, SPSR Nellore District and transfer the same to the Court of Senior Civil Judge, Gudur, SPSR Nellore District.

2. Wife filed this application. According to her affidavit, her marriage with respondent was solemnized on 12.05.2013 at G.S.Rayalu Kalyana Mandapam at Gudur, SPSR Nellore District, according to Hindu rites and caste custom and at the time of marriage, respondent was working as software engineer in Oracle, Hyderabad, and her in-laws were living at Kovuru. She stated that she joined respondent at Kovuru and stayed there for 5 days and returned to her parents house and respondent never showed any love and affection towards her during her stay at Hyderabad. She stated that she was harassed by husband and now she is living at her parents house. She stated that she filed M.C.No.

10 of 2016 on the file of Additional Judicial Magistrate of First Class, Gudur, SPSR Nellore District, seeking maintenance and that it is difficult for her to travel from Gudur to Kovuru as there is no direct conveyance and she has to change three buses to reach Kovuru from Gudur and she is finding it difficult to undertake journey along with the child. For these reasons she prayed for transfer of H.M.O.P.No.8 of 2016 from the Court of Senior Civil Judge, Kovuru, SPSR Nellore District to the Court of Senior Civil Judge, Gudur, SPSR Nellore District.

3. This Court permitted petitioner to take out personal notice on respondent through Registered Post with Acknowledgement Due and in compliance of the said order, advocate for petitioner filed a memo dated 05.08.2016 stating that notice is duly served on respondent and

filed postal acknowledgement along with memo. In spite of service of notice, respondent neither appeared in person nor through any advocate.

4. Heard arguments of advocate for petitioner.

5. Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of wife, H.M.O.P.No.8 of 2016 is withdrawn from the Court of Senior Civil Judge, Kovuru, SPSR Nellore District, and transferred to the Court of Senior Civil Judge, Gudur, SPSR Nellore District, for disposal in accordance with law.

6. The petition is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 10th August, 2016.
