This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not paying the compensation and damages to the petitioner as per the guidelines issued under Sections 67 and 68 of the Electricity Act 2003 read with Section 10 and 16 of the Indian Telegraph Act 1885 with all statutory benefits as contemplated under law as illegal and arbitrary. 2.

Heard the learned counsel for the petitioner and Sri N.Siva Reddy, the learned Standing Counsel for AP Transco. 3.

It is the case of the petitioner that he owned the agricultural land in survey No.763/4B, 763/5 and 763/1 of Palamaner, Chittoor district. It is the case of the petitioner that the respondents are laying HT lines through his land without paying any compensation. The learned standing counsel submitted that the Government of Andhra Pradesh, Energy, Infrastructure & Investment (Pr.II.A2) Department issued G.O.Rt.No.83, dated 20.06.2017, framing the guidelines for payment of compensation to the ryots. The learned standing counsel further submitted that the respondents are ready and willing to pay compensation to the petitioner in terms of G.O.Rt.No.83.

In view of the submissions made by both counsel, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the fourth respondent is hereby directed to fix the compensation and pay the same in respect of the land of the petitioner being affected in view of laying of HT line in the light of G.O.Rt.No.83, dated 20.06.2017, as expeditiously as possible.

With the above direction, writ petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
