This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.3 seeking his enlargement on bail in connection with FIR No.471 of 2025 of Nizamabad I-Town Police Station, Nizamabad. The offences alleged against the petitioner are under Sections 143 (1)(f), 143(4) of Bharatiya Nyaya Sanhita (for short 'BNS') and under Section 81 of Juvenile Justice Act. 2.
The case of the prosecution is that the Counselor of Child Welfare Committee lodged a report before police on 20.12.2025
- 2 - stating that on the same day at about 8.49 hours she received a phone call informing that a muslim family sold a male child aged about 8-9 months to unknown persons at Railway Station, Nizamabad and upon receiving the said information, she conducted enquiry and came to know that A.4 and A.5 sold the child to A.3 at the instance of A.1 and A.2. Hence, requested the police for taking necessary action. Basing on the said complaint police registered the against the accused case for the above offences.

Heard Sri C.Naresh Reddy, learned counsel appearing for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is in jail from 21.12.2025. Petitioner is innocent of the said allegations and that there is no such human trafficking committed by the petitioner. As the petitioner is having three daughters, he wanted to have a male child. As such, instead of adopting the child he purchased the child from A.4 and A.5 being unaware of the law. The investigation is already completed. Hence, prayed this Court to grant regular bail to the petitioner

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the allegations against the petitioner are serious and heinous in nature. Investigation is not yet completed and the petitioner is involved in a human trafficking case. As such, at this stage, petitioner is not entitled for bail and prayed to dismiss this petition. 6.
Considering the submissions made and a perusal of material on record, petitioner is in jail from 21.12.2025. the allegation against the petitioner is that instead of adopting the child as per law, he purchased the child from A.4 and A.5. Considering the period of period of incarceration of petitioner in jail and the allegations against him, this Court deems it appropriate to grant regular bail to the petitioner subject to the following conditions :
i. The petitioner/A.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of I-Additional Judicial First Class Magistrate at Nizamabad.
ii. The petitioner/A.3 shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
- 4 - iii. The petitioner/A.3 shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
