... PETITIONER AND The State of Telangana, Rep. by Principal Secretary, Home Department, Secretariat, Hyderabad and two others.

...RESPONDENTS Counsel for the Petitioner: MR. MOHD MUMTAZ PASHA Counsel for the Respondents: GP FOR HOME (TG) The Court made the following:

ORDER:

The grievance of the petitioner is that the third respondent is not investigating Cr.No.772 of 2014 registered as early as on 18.11.2014.

2. Instructions of the learned Assistant Government Pleader, however, show that the investigation was completed by examining L.Ws.1 to 8 and that A1 and A4 were given notice under Section 41(a)(1) of the Criminal Procedure Code and their explanation is also examined, which is found not satisfactory. Based on the evidence, therefore, a charge sheet was already filed before the III Metropolitan Magistrate, Cyberabad at L.B. Nagar on 21.02.2015 and the same is stated to be now numbered as C.C.No.224 of 2015. A copy of the charge sheet is also produced along with instructions.

3. Since the charge sheet is already filed, no further orders are necessary to be passed in this writ petition.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J April 6, 2015 DSK
