SMT JUSTICE T.RAJANI CRIMINAL PETITION No.809 of 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.131 of 2017 on the file of the Station House Officer, Mahadevpur, Jayashankar District. The offences alleged are under Sections 307, 279, 323 r/w 34 of IPC.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

The case of the prosecution is that on 19.11.2017 the petitioner, who is driving a car, dashed the vehicle of the de facto complainant; when the de facto complaint got down from the vehicle, the petitioner and the inmates of the car took up arguments and beat the de facto complainant with hands; the de facto complainant went to the police station on an unknown bike by asking lift and while he was going to the police station, at Bommapur X Road, again the petitioner came in high speed, in his car, and intentionally dashed the bike, on which the de facto complainant going to police station for giving complaint; as a result, the de facto complainant fell down on the road and sustained injuries.

The facts of the case do not entitle grant of anticipatory bail to the petitioner. However, the petitioner/accused No.1 is directed to surrender before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work. 5.
Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
