HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22652 OF 2016 ORDER:
This writ petition is filed for a writ of mandamus declaring the action of the respondents in proposing to convert the land admeasuring Ac.10-00 of land in Sy.No.222, 221/1C, 221/1A, 45-1 situated at Motupalli Village, Chinaganjam Mandal, Prakasham District into house sites and allotting the same to the neighboring Village, as illegal and arbritray. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue on instructions submits that the 4th respondent in his proceedings dated 25.07.2016 stated that the land in Sy.No.45/1 admeasuring Ac.5.11 cents and 222/1 admeasuring Ac-3.40 cents were classified as burial ground and that the land in Sy.No.222/1 is subdivided into 3 sub-divisions due to formation of canal long back. He further submits that the 4th respondent has not taken any action for issuance of house site D.K.pattas in the said lands.
In view of the aforesaid submission, it is clear that the 4th respondent has not allotted any house site pattas to neighboring village people as alleged by the petitioner. Hence, the writ petition is misconceived and is liable to be dismissed. Accordingly, the writ petition is dismissed. No costs.
